2. Scope & Acceptance
These Terms & Conditions govern every order placed on maison-perfumes.com (“we”, “us”, “the Seller”) by a customer (“you”, “the Buyer”). By placing an order you confirm you are at least 18 years old (or have guardian consent) and agree to these Terms. Products are offered for personal use only, not for resale.
Nothing in these Terms limits or excludes any right you have under mandatory consumer protection law of the European Union or Slovakia. Where a clause below conflicts with such a mandatory right, the mandatory right prevails.
3. Order Process & Contract Formation
Adding items to your cart and submitting checkout is an offer to buy, not an accepted contract. The contract of sale is formed only when we send you an order confirmation email — not upon submission of the order and not upon payment. Payment taken before confirmation (e.g. by PayPal) does not itself create a binding contract; if we are unable to accept an order (stock, pricing, or fraud-prevention reasons — see §13), it will be cancelled and any payment refunded in full.
We reserve the right to refuse or cancel any order, before or after confirmation, on reasonable grounds including suspected fraud, pricing errors, stock unavailability, or a delivery destination we cannot reasonably serve.
4. Products Offered
We offer two categories of product:
- Full-size fragrances — original, factory-sealed bottles.
- Decants / samples — 1 ml, 2 ml, 5 ml, 10 ml, hand-decanted by us from an original, authentic full-size bottle into a labeled branded vial. Decants are not factory-sealed manufacturer packaging; they are our own repackaging of authentic fragrance, clearly presented as such at the point of sale.
5. Product Batches, Discontinued Collections & Packaging Variation
Niche and designer perfumery is regularly reformulated, and packaging is periodically redesigned by the manufacturer. Because our stock includes earlier production batches and, at times, discontinued collections, the bottle design, cap, label, box, juice color, batch code, and — occasionally — minor scent nuances of the item you receive may differ from images or descriptions matching the current retail version sold elsewhere.
This variation is inherent to the category, not a fault, defect, or non-conformity, and is not by itself grounds for a “not as described” claim, a return, or a refund, provided the fragrance itself is authentic and matches the named product. This does not affect your statutory right to goods that are genuine, safe, and fit for purpose (§10), nor your 14-day withdrawal right on unopened items (§6).
6. Withdrawal & Returns
You have a 14-day statutory right of withdrawal under EU Directive 2011/83/EU for goods delivered sealed and unopened. Under Article 16(e) of that Directive, this right does not apply once a sealed fragrance has been unsealed, opened, used, or its hygiene seal broken — perfume is a hygiene-sensitive good exempt from withdrawal once opened. Decants, being sold already outside a factory seal, are non-returnable once the vial has been opened or used. Full detail: see our Return Policy.
Nothing in this clause limits your statutory right to withdraw from an order for goods still in their original sealed condition, or your statutory rights regarding faulty or non-conforming goods (§10).
7. Shipping & Delivery
Fragrances are flammable liquids under transport regulation and travel by ground carrier only (Packeta, DPD, GLS) — never air or express. Delivery costs and estimated times vary by destination; see our Shipping & Payment page for the current table. Risk of loss or damage in transit passes to you upon delivery to the address you provided, in line with statutory rules on risk transfer to consumers.
8. Non-Delivery Claims — Shipments Outside Europe
Ground shipping to destinations outside Europe routinely takes longer than within the EU/EEA and can, depending on customs processing and last-mile carriers in the destination country, take 15 to 50 days from dispatch. Accordingly, for orders shipped outside Europe, a claim that an order was “not delivered” cannot be processed, and no non-delivery refund will be issued, until 50 days have elapsed from the dispatch date, provided tracking shows the shipment in transit. Tracking data governs over subjective delivery-time expectations. This clause addresses claims processing only; it does not reduce your statutory rights if goods are ultimately lost, or your right to a refund if we are unable to complete delivery at all.
9. Statutory Conformity Guarantee
Independently of the withdrawal right in §6, you are entitled to the statutory 2-year guarantee of conformity for goods that are faulty, damaged in transit, or not as described in a way not covered by §5 (batch/packaging variation). This right is not affected by, and cannot be limited by, any clause in these Terms.
10. Pricing & Payment
Prices are listed in EUR and include applicable taxes at the time of order. Payment methods: PayPal or Bank Transfer (SEPA/BACS). In the event of an obvious pricing error (e.g. a manifestly incorrect price caused by a technical, typographical, or data error), we reserve the right to cancel the affected order and issue a full refund, even after order confirmation, rather than honor the erroneous price.
11. Customs Duties & Import Taxes (Non-EU Orders)
For orders shipped outside the European Union, any import duties, customs fees, or local taxes levied by the destination country are the responsibility of the buyer and are not included in our prices or shipping charges. We have no control over these charges and cannot predict their amount.
12. Force Majeure & Carrier Delays
We are not liable for delay or failure to perform caused by circumstances beyond our reasonable control, including but not limited to natural disaster, strikes, war, customs action, carrier disruption, or public health measures. Delays caused by the courier network (weather, customs backlogs, local delivery issues) are not treated as a breach by the Seller, without prejudice to your statutory rights if delivery ultimately fails.
13. Fraud Prevention & Chargebacks
We retain order, payment, tracking, and — for higher-value shipments — photo/video packing documentation as evidence in the event of a payment dispute, chargeback, or fraud investigation. Filing a chargeback or dispute for an order that was delivered as confirmed by carrier tracking, without first contacting us, may be contested using this evidence. This does not affect your right to raise a genuine dispute directly with us or your bank.
14. Liability Limitation
We are not liable for allergic reactions, skin sensitivity, or individual incompatibility with a fragrance — always patch-test before full application. Except for statutory rights that cannot be excluded, we are not liable for indirect or consequential losses.
15. Complaints & Dispute Resolution
If you have a complaint, contact us first at info@maison-perfumes.com — most issues are resolved directly and quickly. If we cannot resolve a complaint to your satisfaction, EU consumers may use the European Commission’s Online Dispute Resolution (ODR) platform: ec.europa.eu/consumers/odr.
16. Governing Law
These Terms are governed by the laws of the Slovak Republic and applicable EU consumer protection law, including Directive 2011/83/EU. This does not deprive you of protection under any mandatory consumer-protection provisions of the law of the country in which you are resident, where applicable.
17. Changes to These Terms
We may update these Terms from time to time; the version in force at the time you place an order applies to that order. Material changes will be reflected by the “last updated” date on this page.
